Declaration of Non‐Collusion:

I, the undersigned, hereby declare that I understand and am aware that any [organisation] staff member who:

  1. Aids a potential supplier to [organisation] in fixing or adjusting the amount of their tender by or in accordance with any agreement or arrangement with themselves or any other person; or
  2. Communicates to any potential supplier to [organisation] or to any person outside the [organisation] the amount or approximate amount of allocated budget or previously obtained commercial information which may influence or affect the bid proposal of such potential supplier or 3rd party; or
  3. Enters into any agreement or arrangement with any potential supplier to [organisation] or 3rd party to induce such potential supplier or 3rd party to refrain from tendering or to influence as to the amount of any tender to be submitted; or
  4. Offers or agrees to pay or give, or does pay or gives, any sum of money, inducement or valuable consideration, directly or indirectly, to any person for doing or having done, or causing or having caused to be done, in relation to any procurement exercise or proposed procurement exercise, any act or omission; or
  5. Offers or agrees to take or receive, or does take or receives, any sum of money, inducement or valuable consideration, directly or indirectly, from any person for doing or having done, or causing or having caused to be done, in relation to any procurement exercise or proposed procurement exercise, any act or omission;

will (without prejudice to any other civil remedies available to the [organisation] and without prejudice to any criminal liability which such conduct by a staff member may attract) be disqualified from the procurement process.

I hereby certify that I know of no such collusion or collusive arrangement and undertake to declare any such that shall come to my attention at any point in the procurement process. I understand that participating in, or failing to declare knowledge of, such an act may result in my exclusion from part or all of the procurement process and may result in disciplinary or legal actions being brought against me.

Declaration Regarding Canvassing:

I, the undersigned, hereby declare that I understand and am aware that any [organisation] staff member who:

  1. directly or indirectly canvasses any members, and/or officials and/or agents of the [organisation] concerning the award of a Contract; or
  2. who directly or indirectly obtains or attempts to obtain information from any such members, officials or agents of the University concerning a procurement exercise on behalf of a potential supplier to [organisation] or any 3rd party;

will be excluded from the procurement process and may face disciplinary charges.

I hereby certify that I have neither taken part in, nor know of, any such canvassing activity. I undertake to declare any such activity that shall come to my attention at any point in the procurement process. I understand that participating in, or failing to declare knowledge of, such an act may result in my exclusion from part or all of the procurement process and may result in disciplinary actions being brought against me.

Declaration Regarding Conflict of Interest:

I, the undersigned, hereby declare that I understand and am aware that any [organisation] staff member who:

  1. has or may have a personal interest (which may include financial interests) which may compromise, or have the appearance of, or potential for, compromising professional judgement and integrity; or
  2. has a financial interest (e.g. holding shares or options) in a potential tenderer or any entity involved in any tendering consortium; or
  3. has received or may receive any kind of monetary payment or non‐monetary gift or incentive (including hospitality) from any tenderer or its representatives; or
  4. has a historical or current relationship with, or has a close family member or personal friend with a historical or current relationship with any potential tenderer; and
  5. who is involved in a Procurement Exercise

must disclose such a potential conflict in writing prior to becoming involved with any Procurement Exercise. I understand that I may be excluded from the procurement process where the identified conflict is, in the Procurement Department’s opinion, material and cannot be mitigated.

OPTION 1:

I hereby declare that I do not have any conflicts of interest which prevent my full and unprejudiced participation in any procurement process. I further declare that I will inform the University immediately should my circumstances change in any way that affects this declaration.

OPTION 2:

I hereby declare that I DO have a conflict of interest which may prevent my full and unprejudiced participation in a procurement exercise. The nature of this conflict of interest is described below:

Confidentiality Undertaking

I hereby declare that I understand I may be invited to participate either directly or indirectly in a Procurement Exercise and herewith agree the following:

  1. To treat all information and documents under conditions of strict confidentiality;
  2. Not to disclose, make copies of, or discuss any received information with any person who is not a member of the Procurement Exercise (without the prior written approval of the Project Sponsor or Procurement);
  3. Not to use (or authorise any other person to use) information and documents other than for the purpose of my work in connection with the Procurement Exercise;
  4. To return documents to Procurement as soon as the evaluation process is complete.

Unless otherwise agreed with the Project Sponsor or Procurement, and subject to relevant legislation, this undertaking applies until the end of each awarded contract, including any contract extensions.

This undertaking shall not apply to any document or information which becomes public knowledge otherwise than as a result of a breach of any of the above undertakings.
